Even if they only last 2 years and even if one spouse dies 16 years later !    This recent Minnesota probate case highlights how “busy” estate lawsuits can be after your dead.    This   probate litigation case   involves a charitable remainder trust, a revocable trust, a power of attorney and the   moving of  bonds from a trust account    to a pay on death account, and ex-wife, a friend who inherits the whole estate, and  children who are disinherited and are contesting the will —  based on undue influence and lack of capacity to make a will. Oh yes, who pays the income tax on those trust distributions?

This recent Arkansas probate litigation case shows you what type of   probate litigation   can erupt after one spouse loses another spouse and has a “friend” or “companion.”  Trust lawsuits,   changing bank accounts, buying condos, and    powers of attorney    are at the center of this inheritance lawsuit involving Dad’s companion, a trustee of his trust and 2 sons who are alledged to have taken a pay on death bank account— while dad was in hospice care.    See, these probate lawsuits don’t occur just in Florida.

This Texas case, whose opinion was published just a few days ago, touches on two issues that are  very common for Palm Beach probate litigators     who are involved in estate litigation:  modifying  the  terms o f  a  trust    and settlement    agreements    for probate lawsuits which result from a mediation conference.  Most Florida probate courts, including the Palm Beach probate courts and the Ft. Lauderdale probate courts,   often require parties to a probate lawsuit to go to mediation.    Mediation is an attempt to resolve   issues involving inheritance fights, or probate litigation and estate lawsuits.

This recent Illinois case shows you that   Ponzi schemes   are still going on, even in a post Madoff era.  Trustees of family trusts    and    marital trusts    need to be cautious about where they invest trust funds and who they invest with.   Trustees or any individual investor who is considering investing money may want to read this trust lawsuit case involving fraud and ask yourself 2 questions:   1)   Was this prudent investing  on the part of the trustees of the family trust ?    2)    Shouldn’t I just    invest trust assets with a large trust company   ?
